Why Could YNW Melly Be Facing Death Penalty? – Rapper YNW Melly may be sentenced to death if found guilty after a Florida Appeals court declared that a judge’s ruling in his murder prosecution was erroneous.
Judge Andrew Siegel’s decision to prohibit prosecutors from seeking the death penalty was overturned, according to Billboard, by Florida’s District Court of Appeal. In July, Siegel issued the decision, finding that prosecutors had broken the law by failing to notify Melly and his attorneys in a timely manner that they intended to pursue the death penalty. However, the District Court of Appeal for Florida ruled that because the notice was given when Melly was accused in 2019, prosecutors adhered to state regulations.
Melly might receive the death penalty if found guilty in his future trial. Before the Florida Supreme Court rules on the matter, a decision will be made. In its decision, the court stated that “notice is notice.”
Judge Spencer D. Levine wrote;
“We find that the state complied with its statutory obligations when it filed its notice of intent to seek the death penalty within 45 days of arraignment,”
“The fact that the state filed a superseding indictment, requiring a second arraignment, does not vitiate the already filed and timely notice of intent. … The defendant has had nearly three years to start the preparation of his defense to the state seeking the death penalty [and] the record contains no evidence that the defendant was prejudiced in any way.”
Why Could YNW Melly Be Facing Death Penalty?
If the rapper is found guilty of first-degree murder, the rapper may face the death penalty, according to an appellate judge.
YNW Melly has entered a not-guilty plea to the charges of first-degree murder. The musician’s trial has been postponed numerous times; it was most recently scheduled to start in July but was postponed while the issue of the death sentence was being decided.
