In the midst of the Partygate scandal, Bailey resigned from his post as the head of the London Assembly’s police and crime committee after it was claimed that a photo of him at a gathering in December 2021 at the Conservative Campaign Headquarters violated COVID-19 restrictions that were in effect at the time in the UK.

The Times reported in December 2021 that Bailey, the party’s candidate for mayor of London, attended a meeting on December 14, 2020, in the basement of the Conservative Party’s Westminster headquarters, along with four seconded staff members from Conservative Campaign Headquarters.
It was claimed that doing so violated the tier 2 coronavirus regulations in effect at the time. It was claimed that a Conservative donor gave Bailey a Lego kit. While his four assistants received punishment, Bailey did not.
Nick Candy, a developer, was also there, according to a snapshot of the event released on December 14, 2021, by The Daily Mirror. Additionally, the image showed party hats on the guests and indicated that there was a buffet and booze accessible for consumption.
Bailey’s leadership of the police and crime committee of the London Assembly was terminated as a result of the publication of the image.
In addition to his retirement from the police and crime committee in December, Bailey also announced his resignation as chair of the economy committee on January 11th, 2022.
